New Delhi: The Supreme Court said on Thursday that it will take up on Friday a petition filed by a Muslim woman who has received two divorce notices from her husband and is expecting to get a third soon.
A Vacation Bench said this after Benazir Hina approached the apex court through lawyer and Bharatiya Janata Party leader Ashwini Kumar Upadhyay, who said his client was facing a lot of difficulty.
Justices AS Bopanna and Vikram Nath agreed to hear the matter on Friday.
Upadhyay said the petitioner had got two divorce notices and was likely to get the third notice on June 19.
He also mentioned the plea challenging Talaq-e-Hasan — a religious practice — before the Supreme Court and sought an urgent hearing.
Hina, a Muslim woman journalist, moved the Supreme Court challenging the practice of Talaq-e-Hasan, by which a Muslim man can divorce his wife by saying the word “talaq” once a month, for three months.
Hina has argued that the practice of Talaq-e-Hasan is unconstitutional as it is irrational, arbitrary and violates Articles 14, 15, 21 and 25 of the Constitution.
The police reportedly told her that the practice is permissible under Sharia law.
