New Delhi:The Supreme Court on Friday refused to entertain a writ petition filed by West Bengal BJP leader Suvendu Adhikari challenging the West Bengal Speaker’s decision to reject a plea seeking disqualification of Mukul Roy for defecting from the BJP to the Trinamool Congress (TMC). A Bench of the Supreme Court headed by Justice L Nageswara Rao and comprising Justice B R Gavai refused to entertain Adhikari’s petition. “This court is of the opinion not to entertain the petition, Sorry,” the apex court said and asked the petitioner to move the Calcutta High Court for any relief. C S Vaidyanathan, a senior lawyer appearing for Adhikari, submitted to the Supreme Court that the Assembly Speaker’s decision was wholly arbitrary. The Supreme Court asked Vaidyanathan as to what was the fundamental right of the petitioner (Adhikari) which was infringed so as to give a cause for a petition under Article 32 of the Indian Constitution. Considering that the term of Mukul Roy as the Public Accounts Committee Chairman is only for one year, the Supreme Court asked the High Court to decide the matter, preferably within a month. UNI SM MR
